DFSA crypto token rules are in force in the DIFC

On 12 January 2026 the Dubai Financial Services Authority said it had that day brought into force an updated regulatory framework for crypto tokens in the Dubai International Financial Centre. The change follows a consultation in October 2025. It applies in the DIFC. It is not a rule for every regulator or free zone in the United Arab Emirates.
Key facts
- The DFSA said the updated crypto-token rules came into force on 12 January 2026.
- The rules apply in the Dubai International Financial Centre.
- Firms assess token suitability themselves. The DFSA no longer publishes a recognised-token list.
The DFSA describes itself as the independent regulator of financial services and markets in the DIFC. The notice says the updated rules give firms greater clarity and add safeguards, conduct and operational requirements, and proportionate reporting. A key change is the move from a DFSA-led suitability assessment to a firm-led one. A firm that provides financial services involving crypto tokens is now responsible for deciding, on a reasoned and documented basis, whether each token meets the DFSA’s suitability criteria.
Because of that shift, the DFSA says it will no longer publish a list of recognised crypto tokens. The notice does not reproduce the suitability criteria, the reporting fields, or the notice of amendments. Those documents are linked from the DFSA page and are not restated here. The framework is described as covering trading, fund and asset management, custody, advisory and related financial services for firms operating or seeking to operate in the DIFC.
The notice says the new rules came into force on 12 January 2026. It also said the DFSA would host a webinar on 27 January 2026 to explain the approach. That webinar date has passed, and this briefing does not report what was said in the session. Charlotte Robins, Managing Director, Policy and Legal, is quoted in the notice on the aim of a transparent framework that safeguards market integrity. The quote is not a statement that every token in the DIFC is suitable.
Why it matters for investors and traders
A firm in the DIFC can no longer point to a DFSA published list as the suitability decision. The decision sits with the firm, and it has to be reasoned and documented. Firms outside the DIFC are not brought under this notice.
Markets discussed: Cryptoassets. These are the subjects of the briefing, not a list of markets that moved.
Uncertainties
- The suitability criteria are in the DFSA’s supervisory guidelines. They are not copied here.
- The notice does not say how the DFSA will test a firm’s documented assessment.
- Other UAE authorities regulate virtual assets outside the DIFC. This notice does not state their rules.
What to watch next
- Read a DIFC firm’s own token assessment. The absence of a DFSA list is not an approval of a token.
- Keep this framework separate from rules made by other UAE authorities.
- The 27 January 2026 webinar was an explanation session. It was not a second commencement date.
