ESMA updates transparency guidance for OTC derivatives and tick sizes

On 15 October 2026 the European Securities and Markets Authority updated its manual on transparency. The update gives further guidance on identifying over-the-counter derivatives that are subject to transparency requirements, and on the tick-size regime. ESMA says the part of the manual that deals with OTC identifying reference data should be treated as a draft until the related technical standards are in force.

Key facts

  • The manual update is dated 15 October 2026.
  • It covers identification of OTC derivatives for transparency, and the tick-size regime.
  • ESMA says the OTC reference-data guidance remains a draft until RTS 2 and the consolidated-tape standards are in force.

ESMA says the update also clarifies how identifying reference data for OTC derivatives should be provided for transparency, so that data reported to and published through the consolidated tape is more consistent. The manual includes published questions and answers on the tick-size regime, and recommendations on when trading venues and national authorities may intervene in specific circumstances. This briefing does not reproduce those questions.

The next-step paragraph is the limit on how final the document is. ESMA says that, for the guidance on OTC identifying reference data, the updated manual should be considered a draft until the related technical standards enter into force. It names RTS 2 and the RTS on consolidated-tape input and output data. Guidance that is still a draft is not described here as a rule already in force.

The audience is firms and venues that identify OTC derivatives for transparency and that apply tick sizes. A provider’s claim that a platform has cheaper prices or faster data is not evidence in this manual, and this page does not treat a vendor’s performance claim as tested. The manual is about how transparency data is identified and published. It is not a new retail leverage rule.

Why it matters for investors and traders

Trading venues and firms that report OTC derivative transparency have a clearer supervisory text, and a warning that one part of it is not final. Clients do not get a new retail product rule from this manual.

Uncertainties

  • The date on which RTS 2 and the consolidated-tape standards enter into force is not stated in the release used here.
  • The questions and answers are incorporated by reference and are not copied onto this page.
  • When a venue or authority may intervene on tick size depends on circumstances the release does not list.

What to watch next

  • Treat the OTC reference-data section as draft until the technical standards ESMA names are in force.
  • Separate this transparency guidance from a retail product intervention.
  • Use the manual itself for the tick-size recommendations. This page only records that they were added.

How to read this development

GuidanceEuropean UnionEuropean Securities and Markets Authority

The official document is dated 15 October 2026. This briefing was published on 22 October 2026. A later status would be added as a new entry. The original status stays in the record.

Who is affected

Trading venues, national authorities and firms that identify OTC derivatives for transparency or apply the tick-size regime. Retail product rules are not the subject.

What changes

Further guidance on which OTC derivatives are transparent, how their reference data is identified, and how the tick-size regime is supervised. Part of that guidance is expressly still a draft.

When it applies

The news release is dated 15 October 2026. ESMA does not give a commencement date for the draft reference-data section. It ties that section to the later entry into force of the technical standards.

Status history

  • 15 October 2026. Guidance. Manual updated. OTC identifying-reference-data guidance is still described as a draft until named technical standards are in force.
