ESMA sets expectations for services in stablecoins that do not comply with MiCA

On 8 October 2026 the European Securities and Markets Authority published an opinion on crypto-asset services that involve asset-referenced tokens and e-money tokens which do not comply with the Markets in Crypto-Assets Regulation. The opinion is about those non-compliant tokens. It is not a statement about every stablecoin, and it is not a broker rule for firms outside the European Union.

Key facts

  • The opinion is dated 8 October 2026.
  • It concerns asset-referenced tokens and e-money tokens that do not comply with MiCA, not every stablecoin.
  • Pre-existing exposures are to be remediated no later than three months after publication. That period is not restated here as a calendar day.

ESMA says crypto-asset service providers authorised under MiCA should cease providing services related to non-MiCA-compliant stablecoins to clients in the European Union. The services named are the crypto-asset services covered by MiCA, including trading platforms, exchange, execution of orders, placing, reception and transmission of orders, advice, transfers, custody and administration, and portfolio management. The opinion asks national authorities to supervise that firms do not maintain, introduce or facilitate client access to those tokens, including controls against clients acquiring or increasing exposure.

Where a national authority finds remaining pre-existing exposures, ESMA says they should be remediated as soon as possible and no later than three months after publication of the opinion. Any continuation of services should be limited to what is necessary for liquidation, conversion, withdrawal, transfer or safekeeping, and should stay time-limited and supervised. The opinion does not convert that three-month period into a calendar day on this page.

The tokens in scope are asset-referenced tokens and e-money tokens that do not comply with MiCA. A stablecoin that meets MiCA is outside that sentence. A broker or exchange supervised only outside the European Union is not brought under MiCA by this opinion. A firm that serves both EU and non-EU clients can have different duties for each group. This page does not decide which of a firm’s tokens fail MiCA.

Why it matters for investors and traders

An EU crypto-asset service provider may have to stop trading, custody and transfer services in particular stablecoins for EU clients. A client cannot assume that a token still listed on a non-EU venue is available, on the same terms, through an EU-authorised provider.

Markets discussed: Digital assets. These are the subjects of the briefing, not a list of markets that moved.

Uncertainties

  • Which tokens fail MiCA is not listed in the opinion summary used here.
  • The three-month remediation period is measured from publication. This page does not convert it into a dated deadline.
  • Firms outside MiCA are not given an EU permission, or an EU prohibition, by this opinion alone.

What to watch next

  • Ask which legal entity provides the service and whether it is authorised under MiCA.
  • Separate a non-compliant asset-referenced or e-money token from a stablecoin the opinion does not cover.
  • Treat a wind-down service as limited to liquidation, conversion, withdrawal, transfer or safekeeping.

The official document is dated 8 October 2026. This briefing was published on 22 October 2026. A later status would be added as a new entry. The original status stays in the record.

Who is affected

Crypto-asset service providers authorised under MiCA, their EU clients, and the national authorities ESMA asks to supervise the restriction. Providers outside that regime are not reclassified here.

What changes

ESMA expects services related to non-compliant asset-referenced and e-money tokens to stop for EU clients, with a narrow wind-down for existing exposures. Compliant tokens are outside the opinion’s sentence.

When it applies

The opinion is dated 8 October 2026. Remediation of pre-existing exposures is described as no later than three months after publication, not as a date this page has calculated.

Status history

  • 8 October 2026. Supervisory opinion. Expectations for services in non-MiCA-compliant asset-referenced and e-money tokens. Not a rule for every stablecoin.
